Allgemeine Geschäftsbedingungen

1. Allgemeines

1.1 Die vorliegenden Allgemeinen Geschäftsbedingungen (AGB) enthalten die zwischen uns, der Rick Maschke, Im Dorfe 13A, 21409 Embsen, Deutschland (im Folgenden „Verkäufer“ oder „wir“) und einem Verbraucher oder Unternehmer (im Folgenden „Kunden“) ausschließlich geltenden Bedingungen für den Kauf der angebotenen Waren und Dienstleistungen, soweit diese nicht durch schriftliche Vereinbarungen zwischen den Parteien abgeändert werden.

Verbraucher im Sinne dieser AGB ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können. Unternehmer im Sinne dieser AGB ist eine natürliche oder juristische Person oder eine rechtsfähige Personengesellschaft, die bei Abschluss eines Rechtsgeschäfts in Ausübung ihrer gewerblichen oder selbständigen beruflichen Tätigkeit handelt.

1.2. Änderungen dieser Geschäftsbedingungen werden dem Kunden schriftlich, per Telefax oder per E-Mail mitgeteilt. Widerspricht der Kunde dieser Änderung nicht innerhalb von vier Wochen nach Zugang der Mitteilung, gelten die Änderungen durch den Kunden als anerkannt.

 

2. Vertragsschluss

2.1. Die Präsentation der angebotenen Waren und Dienstleistungen stellt kein bindendes Angebot des Verkäufers dar. Erst die Bestellung einer Ware oder Dienstleistung durch den Kunden stellt ein bindendes Angebot nach § 145 BGB dar. Im Falle der Annahme des Kaufangebots durch den Verkäufer versendet dieser an den Kunden eine Auftragsbestätigung per E-Mail.

2.2. Nach der Abgabe des Angebots und erfolgreichem Abschluss der Bestellung, erhält der Kunde eine Kaufbestätigung per E-Mail mit den relevanten Daten. Der Kunde stellt sicher, dass die von ihm eingegebene E-Mail-Adresse korrekt ist.

2.3. Während des Bestellprozesses hat der Kunde die Möglichkeit die getätigten Eingaben zu korrigieren. Vor Abschluss des Bestellprozesses erhält der Kunde eine Zusammenfassung aller Bestelldetails und erhält die Gelegenheit seine Angaben zu überprüfen.

2.4. Der Vertragsschluss erfolgt in deutscher Sprache.

2.5. Eine Kontaktaufnahme des Kunden durch den Verkäufer erfolgt per E-Mail.

2.6. Bei digitalen Gütern räumt der Verkäufer dem Kunden ein nicht ausschließliches, örtlich und zeitlich unbeschränktes Recht ein, die überlassenen digitalen Inhalte zu privaten sowie zu geschäftlichen Zwecken zu nutzen. Eine Weitergabe der Inhalte an Dritte, sowie eine Vervielfältigung für Dritte ist nicht gestattet, sofern keine Erlaubnis seitens des Verkäufers erteilt wurde.


3. Zahlungsbedingungen 

 

3.1. Der Kaufpreis wird sofort mit Bestellung fällig. Die Zahlung der Ware erfolgt mittels der zur Verfügung gestellten Zahlungsarten.

3.2. Es gelten die zum Zeitpunkt der Bestellung angegebenen Preise. Die in den Preisinformationen genannten Preise enthalten die gesetzliche Umsatzsteuer.

3.3. Gegen Forderungen des Verkäufers kann der Kunde nur mit unbestrittenen oder rechtskräftig festgestellten oder entscheidungsreifen Gegenansprüchen aufrechnen.

 

4. Versandbedingungen

4.1. Der Versand der bestellten Ware erfolgt gemäß den getroffenen Vereinbarungen. Anfallende Versandkosten sind jeweils bei der Produktbeschreibung aufgeführt und werden gesondert auf der Rechnung ausgewiesen.

4.2. Digitale Güter werden dem Kunden in elektronischer Form entweder als Download oder per E-Mail zur Verfügung gestellt.

 

5. Widerrufsrecht

Handelt ein Kunde als Verbraucher gem. §13 BGB, steht ihm grundsätzlich ein gesetzliches Widerrufsrecht zu. Handelt ein Kunde als Unternehmer gem. §14 BGB in Ausübung seiner gewerblichen oder selbständigen beruflichen Tätigkeit, steht ihm kein gesetzliches Widerrufsrecht zu. Nähere Informationen zum Widerrufsrecht ergeben sich aus der Widerrufsbelehrung auf der Bezahlseite des Produktes.

 

6. Offline-Events

Erwirbt der Kunde ein Ticket zu einem Offline-Event, gelten folgende Bestimmungen:

Bei zwingenden organisatorischen oder wirtschaftlichen Gründen, die nicht von dem Veranstalter zu vertreten sind, behält sich der Veranstalter das Recht vor, eine Veranstaltung abzusagen. In diesem Fall wird der Veranstalter den Kunden unverzüglich informieren sowie die Tickets auf eine Folgeveranstaltung umbuchen. Ausfallkosten, gegen die sich der Teilnehmer hätte versichern können (Ticketversicherung, Reiserücktrittskostenversicherung etc.), werden auf keinen Fall erstattet.

Im Falle höherer Gewalt oder behördlicher Absage der Veranstaltung ist eine Haftung durch den Veranstalter ausgeschlossen.

Eine Haftung für Stornierungs- oder Umbuchungsgebühren für vom Kunden gebuchte Transportmittel oder Übernachtungskosten ist ausgeschlossen.

 

7. Gewährleistung

Soweit die gelieferte Ware mangelhaft ist, ist der Kunde im Rahmen der gesetzlichen Bestimmungen berechtigt, Nacherfüllung zu verlangen, von dem Vertrag zurückzutreten bzw. den Vertrag zu beenden, den Kaufpreis zu mindern, Schadensersatz oder den Ersatz vergeblicher Aufwendungen zu verlangen. Vor dem Kauf mitgeteilte Mängel stellen keinen Gewährleistungsfall dar. Die Verjährungsfrist von Gewährleistungsansprüchen für die gelieferte Ware beträgt zwei Jahre ab Erhalt der Ware.

 

8. Haftungsbeschränkung

8.1. Der Verkäufer haftet für Vorsatz und grobe Fahrlässigkeit. Ferner haftet der Verkäufer für die fahrlässige Verletzung von Pflichten, deren Erfüllung die ordnungsgemäße Durchführung des Vertrages überhaupt erst ermöglicht, deren Verletzung die Erreichung des Vertragszwecks gefährdet und auf deren Einhaltung ein Kunde regelmäßig vertraut. Im letztgenannten Fall haftet der Verkäufer jedoch nur für den vorhersehbaren, vertragstypischen Schaden. Der Verkäufer haftet nicht für die leicht fahrlässige Verletzung anderer als der in den vorstehenden Sätzen genannten Pflichten.

8.2. Die vorstehenden Haftungsausschlüsse gelten nicht bei Verletzung von Leben, Körper und Gesundheit. Die Haftung nach Produkthaftungsgesetz bleibt unberührt.

8.3. Die Datenkommunikation über das Internet kann nach dem derzeitigen Stand der Technik nicht fehlerfrei und/oder jederzeit verfügbar gewährleistet werden. Der Verkäufer haftet insoweit weder für die ständige und ununterbrochene Verfügbarkeit des Online-Handelssystems und der Onlineangebote.

8.4. Die Europäische Kommission stellt eine Plattform zur Online-Streitbeilegung (OS) bereit, die Sie unter http://ec.europa.eu/consumers/odr finden. Wir nehmen nicht an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teil.

 

9. Schlussbestimmungen

9.1. Änderungen oder Ergänzungen dieser Geschäftsbedingungen bedürfen der Schriftform. Dies gilt auch für die Aufhebung dieses Schriftformerfordernisses.

9.2. Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts. Zwingende Bestimmungen des Staates, in dem ein Verbraucher seinen gewöhnlichen Aufenthalt hat, bleiben unberührt.

9.3. Soweit ein Verbraucher bei Abschluss des Vertrages seinen Wohnsitz oder gewöhnlichen Aufenthalt in Deutschland hatte und entweder zum Zeitpunkt der Klageerhebung verlegt hat oder seinen Aufenthaltsort zu diesem Zeitpunkt unbekannt ist, ist Gerichtsstand für alle Streitigkeiten der Geschäftssitz des Verkäufers.

Wenn ein Verbraucher seinen Wohnsitz oder gewöhnlichen Aufenthalt nicht in einem Mitgliedsstaat der europäischen Union hat, sind für alle Streitigkeiten die Gerichte am Geschäftssitz des Verkäufers ausschließlich zuständig.

Handelt der Kunde als Kaufmann, juristische Person des öffentlichen Rechts oder öffentlich-rechtliches Sondervermögen mit Sitz im Hoheitsgebiet der Bundesrepublik Deutschland, ist ausschließlicher Gerichtsstand für alle Streitigkeiten aus diesem Vertrag der Geschäftssitz des Verkäufers.

9.4. Sollten einzelne Bestimmungen dieses Vertrages unwirksam sein oder den gesetzlichen Regelungen widersprechen, so wird hierdurch der Vertrag im Übrigen nicht berührt. Die unwirksame Bestimmung wird von den Vertragsparteien einvernehmlich durch eine rechtswirksame Bestimmung ersetzt, welche dem wirtschaftlichen Sinn und Zweck der unwirksamen Bestimmung am nächsten kommt. Die vorstehende Regelung gilt entsprechend bei Regelungslücken.

 

Allgemeine Geschäftsbedingungen der Maschke Akademie und RickFlix

  1. Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Geschäftsbeziehungen zwischen der Maschke Akademie, im Folgenden "Akademie", und ihren Kunden im Bereich der Online-Weiterbildung, insbesondere für die Produkte "Maschke Akademie - Deine begleitende Weiterbildung im Bereich Bildbearbeitung" und "RickFlix".

  1. Leistungen der Akademie

Die Akademie bietet eine Online-Weiterbildung an. Das Wissen wird hauptsächlich durch Videos vermittelt. Zusätzlich können Live-Calls als Teil des Bildungsangebots stattfinden. Die Anzahl der Live-Calls kann variieren. Die Live-Calls sind exklusive Veranstaltungen, an denen nur Akademie-Teilnehmer teilnehmen dürfen.

  1. Live-Calls

Live-Calls finden nicht statt, wenn in einem Bundesland eines Coaches ein Feiertag ist. Darüber hinaus behält sich die Akademie das Recht vor, Live-Calls ohne weiteren Grund abzusagen oder zu verschieben.

  1. Zugang

Der Zugang zur Akademie und den Live-Calls ist grundsätzlich zeitlich unbegrenzt, sobald Sie Teilnehmer der Akademie sind. Ausnahmen können bei Käufern von Sonderangeboten gelten, wobei sich die Zugangsdauer nach der im Angebot spezifizierten Regelung richtet.

  1. RickFlix

Teilnehmer der Akademie haben nicht zwangsläufig Zugang zu RickFlix. Abweichungen können bei Sonderangeboten gelten. RickFlix-Teilnehmer haben Zugang zu einer umfangreichen Bibliothek an Kursen und weiteren Materialien. Darüber hinaus haben RickFlix-Teilnehmer automatisch Zugang zu allen Webinaren, die im Rahmen von RickFlix stattfinden, es sei denn, es treten entsprechende Ausnahmen ein.

  1. Weitergabe von Accountdaten

Die Weitergabe von Accountdaten, durch die mehrere Personen Zugang zu den Kursmaterialien über ein Account haben, ist strengstens untersagt. Ein Verstoß gegen diese Regelung führt zur sofortigen Sperre und zum Entzug des Zugangs.

1) Scope of Application
1.1 These General Terms and Conditions (hereinafter referred to as "GTC") of the company Rick Maschke (hereinafter referred to as "Seller”) shall apply to all contracts concluded between a consumer or a trader (hereinafter referred to as "Client”) and the Seller relating to all goods and/or services presented in the Seller's online shop. The inclusion of the Client’s own conditions is herewith objected to, unless other terms have been stipulated.
1.2 A consumer pursuant to these GTC is any natural person concluding a legal transaction for a purpose attributed neither to a mainly commercial nor a self-employed occupational activity.
1.3 A trader pursuant to these GTC is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity.
1.4 The subject matter of the contract may be - depending on the Seller's contents description - both the one-time provision of digital content and the regular provision of digital content (hereinafter "subscription contract"). In case of the subscription contract, the Seller undertakes to provide the Client with the contractually owed digital content for the duration of the agreed contract term at the contractually agreed time intervals.
1.5 According to the Seller’ product description, the object of the contract may be the supply of goods by way of a one-time delivery or the supply of goods by way of a stable delivery (hereinafter referred to as “subscription contract”). In case of a subscription contract, the Seller commits to supply the Client with the contractually owed goods for the duration of the agreed contract period and at the contractually agreed time intervals.

2) Conclusion of the Contract
2.1 The product descriptions in the Seller’s online shop do not constitute binding offers on the part of the Seller, but merely serve the purpose of submitting a binding offer by the Client.
2.2 The Client may submit the offer via the online order form integrated into the Seller's online shop. In doing so, after having placed the selected goods and/or services in the virtual basket and passed through the ordering process, and by clicking the button finalizing the order process, the Client submits a legally binding offer of contract with regard to the goods and/or services contained in the shopping cart.
2.3 The Seller may accept the Client’s offer within five days,
- by transferring a written order confirmation or an order confirmation in written form (fax or e-mail); insofar receipt of order confirmation by the Client is decisive, or
- by delivering ordered goods to the Client; insofar receipt of goods by the Client is decisive, or
- by requesting the Client to pay after he placed his order.
Provided that several of the aforementioned alternatives apply, the contract shall be concluded at the time when one of the aforementioned alternatives firstly occurs. Should the Seller not accept the Client’s offer within the aforementioned period of time, this shall be deemed as rejecting the offer with the effect that the Client is no longer bound by his statement of intent.
2.4 If a payment method offered by PayPal is selected, the payment will be processed by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter referred to as "PayPal"), subject to the PayPal Terms of Use, available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full?locale.x=en_DE or, if the Client does not have a PayPal account, subject to the Terms for payments without a PayPal account, available at https://www.paypal.com/uk/webapps/mpp/ua/privacywax-full. If the Client pays by means of a method of payment offered by PayPal which can be selected in the online order process, the Seller hereby declares the acceptance of the Client's offer at the time when the Client clicks on the button concluding the order process.
2.5 When submitting an offer via the Seller's online order form, the text of the contract is stored by the Seller after the contract has been concluded and transmitted to the Client in text form (e.g. e-mail, fax or letter) after the order has been sent. The Seller shall not make the contract text accessible beyond this. If the Client has set up a user account in the Seller's online shop prior to sending his order, the order data shall be stored on the Seller's website and can be accessed by the Client free of charge via his password-protected user account by specifying the corresponding login data.
2.6 Prior to submitting a binding order via the Seller’s online order form, the Client may recognize input errors by reading attentively the information displayed on the screen. The enlargement function of the browser to enlarge the display on the screen may be an effective method for better recognizing input errors.
The Client can correct all the data entered via the usual keyboard and mouse function during the electronic ordering process, until he clicks the button finalizing the ordering process.
2.7 The German language is exclusively available for the conclusion of the contract.
2.8 Order processing and contacting usually takes place via e-mail and automated order processing. It is the Client’s responsibility to ensure that the e-mail address he provides for the order processing is accurate so that e-mails sent by the Seller can be received at this address. In particular, it is the Client`s responsibility, if SPAM filters are used, to ensure that all e-mails sent by the Seller or by third parties commissioned by the Seller with the order processing can be delivered.

3) Right to Cancel
3.1 Consumers are entitled to the right to cancel.
3.2 Detailed information about the right to cancel are provided in the Seller’s instruction on cancellation.

4) Prices and Payment Conditions
4.1 Unless otherwise stated in the Seller’s product description, prices indicated are total prices including the statutory sales tax. Delivery costs, where appropriate, will be indicated separately in the respective product description
4.2 Payment can be made using one of the methods mentioned in the Seller’s online shop.
4.3 In case of delivery to countries outside the European Union, additional costs may incur in individual cases for which the Seller is not responsible and which have to be borne by the Client. This includes for example transfer fees charged by banking institutes (transfer charges, exchange fees) or import duties or taxes (customs). Such costs regarding money transfer may also incur, if delivery is not made in a country outside the European Union and the Client carries out the payment from a country outside the European Union.
4.4 If prepayment by bank transfer has been agreed upon, payment is due immediately after conclusion of the contract, unless the parties have arranged a later maturity date
4.5 If the SEPA direct debit payment method is selected, the invoice amount is due for payment after a SEPA direct debit mandate has been issued, but not before the deadline for pre-notification has expired. The direct debit will be collected when the ordered goods leave the seller's warehouse, but not before the deadline for pre-notification has expired. Pre-notification means any communication (e. g. invoice, policy, contract) of the Seller to the Client which announces a debit by means of SEPA direct debit. If the direct debit is not honored due to insufficient account coverage or due to the indication of an incorrect bank account, or if the Client objects to the debit, even though he is not entitled to do so, the Client shall bear the fees arising from the reversal of the respective bank, if he is responsible for this.
4.6 If the SEPA direct debit payment method is selected, the invoice amount is due for payment after a SEPA direct debit mandate has been issued, but not before the deadline for pre-notification has expired. The direct debit will be collected when the ordered goods leave the Seller's warehouse, but not before the deadline for pre-notification has expired. Pre-notification means any communication (e. g. invoice, policy, contract) of the Seller to the Client which announces a debit by means of SEPA direct debit. If the direct debit is not honored due to insufficient account coverage or due to the indication of an incorrect bank account, or if the Client objects to the debit, even though he is not entitled to do so, the Client shall bear the fees arising from the reversal of the respective bank, if he is responsible for this. The Seller reserves the right to carry out a creditworthiness check when the payment method SEPA direct debit is selected and may reject this payment method in the event of a negative creditworthiness check.
4.7 If the payment method “direct debit” is selected, the invoice amount is due immediately upon conclusion of the contract. The payment method “direct debit” requires a successful credit check by Masterpayment LTD, 483 Green Lanes, London, N13 4BS, Great Britain ("Masterpayment"). If the Client is permitted to use direct debit after the creditworthiness of the Client has been verified, the payment shall be processed in cooperation with net-m privatbank 1891 AG, Odeonsplatz 18,80539 München ("net-m privatbank 1891 AG"), to which the Seller assigns his claim for payment. In this case, net-m privatbank 1891 AG is revocably authorized to collect the invoice amount from the indicated Client’s account. In the event of assignment, the Client can only pay to net-m privatbank 1891 AG with debt-diescharging effect. The direct debit takes place when the ordered goods leave the Seller's warehouse. The Seller remains responsible for general customer inquiries, e. g. regarding the goods, delivery time, dispatch, returns, complaints, declarations of revocation and returns or credit notes, even when the payment method “direct debit via Masterpayment” is selected.
4.8 If the payment method "PayPal direct debit" is selected, PayPal collects the invoice amount from the customer's bank account on behalf of the Seller after a SEPA direct debit mandate has been issued, but not before the deadline for pre-notification has expired. Pre-notification means any communication (e. g. invoice, policy, contract) to the Client announcing a debit via SEPA direct debit. If the direct debit is not honored due to insufficient account coverage or due to the indication of an incorrect bank account, or if the Client objects to the debit, even though he is not entitled to do so, the Client shall bear the fees arising from the reversal of the respective bank, if he is responsible for this.
4.9 If the payment method direct debit via Stripe is selected, the payment shall be processed via the payment service provider Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland (hereinafter referred to as "Stripe"). In this case, Stripe collects the invoice amount from the customer's bank account on behalf of the Seller after a SEPA direct debit mandate has been issued, but not before the expiry of the period for pre-notification. Pre-notification is any communication (e.g. invoice, policy, contract) to the Client that announces a debit by means of a SEPA direct debit. If the direct debit is not redeemed due to insufficient funds in the account or due to the indication of incorrect bank details, or if the Client objects to the debit although he is not entitled to do so, the Client shall bear the fees arising from the reversal of the debit entry by the respective credit institution if he is responsible for this. The Seller reserves the right to carry out a credit check when selecting the SEPA direct debit payment method and to reject this payment method in the event of a negative credit check.
4.10 Credit card payment via Stripe
When selecting the payment method credit card, the invoice amount is due immediately upon conclusion of the contract. Payment by credit card is processed in cooperation with Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland (hereinafter referred to as "Stripe"). Stripe reserves the right to carry out a credit assessment and to refuse this payment method if the credit check is negative.
4.11 If a payment method offered via the payment service "PayPal" is selected, the payment shall be processed via PayPal, whereby PayPal may also use the services of third-party payment service providers for this purpose. If the seller also offers payment methods via PayPal that involve advance payments to the client (e.g., purchase on account or payment by instalments), he shall assign his payment claim to PayPal or to the payment service provider commissioned by PayPal and specifically named to the client. Before accepting the seller's declaration of assignment, PayPal or the payment service provider commissioned by PayPal shall carry out a credit check using the transmitted client data. The seller reserves the right to refuse the client the selected payment method in the event of a negative check result. If the selected payment method is approved, the client must pay the invoice amount within the agreed payment period or in the agreed payment intervals. In this case, he can only make payment to PayPal or the payment service provider commissioned by PayPal with debt-discharging effect. However, even in the case of assignment of claims, the seller remains responsible for general customer enquiries, e.g., about the goods, delivery time, dispatch, returns, complaints, cancellation declarations and deliveries or credit notes..

5) Shipment and Delivery Conditions
5.1 If the Seller offers to ship the goods, delivery shall be made within the delivery area specified by the Seller to the delivery address specified by the Client unless otherwise agreed. When processing the transaction, the delivery address specified in the Seller's order processing shall be decisive.
5.2 Should the assigned transport company return the goods to the Seller, because delivery to the Client was not possible, the Client bears the costs for the unsuccessful dispatch. This shall not apply, if the Client exercises his right to cancel effectively, if the delivery cannot be made due to circumstances beyond the Client's control or if he has been temporarily impeded to receive the offered service, unless the Seller has notified the Client about the service for a reasonable time in advance.
5.3 Personal collection is not possible for logistical reasons.
5.4 The Seller reserves the right to withdraw from the contract in the event of incorrect or improper self-supply. This only applies if the Seller is not responsible for the non-supply and if he has concluded a concrete hedging transaction with the supplier. The Seller shall make all reasonable efforts to obtain the goods. In case of non-availability or partial availability of the goods he shall inform the Client and grant him immediately counterperformance.

6) Contract Duration and Contract Termination Regarding Subscription Contracts
6.1 Subscription contracts are concluded for an indefinite period of time and can be terminated by the Client at any time without notice.
6.2 The right to immediate termination for important reasons remains unaffected.
An important reason is considered, when the continuation of the contract is no more reasonable until the end of the agreed contractual period or until expiry of the notice period for termination, taking into account all circumstances of the particular case and with balanced judgement of mutual interests
6.3 Notices of termination can be made in writing, in text form (e.g. by e-mail) or in electronic form via the cancellation feature (cancellation button) provided by the Seller on its website.

7) Reservation of Proprietary Rights
If the Seller provides advance deliveries, he retains title of ownership to the delivered goods, until the purchase price owed has been paid in full.

8) Warranty
8.1 Unless otherwise stipulated , the provisions of the statutory liability for defects shall apply. Deviating therefrom, the following shall apply to contracts for the delivery of goods:
8.2 If the Client acts as trader
- the Seller may choose the type of subsequent performance,
- for new goods, the limitation period for claims for defects shall be one year from delivery of the goods,
- for used goods, the rights and claims for defects are excluded,
- the limitation period shall not recommence if a replacement delivery is made within the scope of liability for defects.
8.3 The above-mentioned limitations of liability and shortening of the period of limitation do not apply
- to claims for damages and reimbursement of expenses of the Client,
- if the Seller has fraudulently concealed the defect,
- for goods which have been used in accordance with their customary use for a building and which have caused its defectiveness,
- for any existing obligation of the Seller to provide updates for digital products with respect to contracts for the supply of goods with digital elements.
8.4 Furthermore, for traders, the statutory limitation periods for any statutory right of recourse that may exist shall remain unaffected.
8.5 If the Client is a businessperson pursuant to section 1 of the German Commercial Code (HGB) he has the commercial duty to examine the goods and notify the Seller of defects pursuant to section 377 HGB. Should the Client neglect the obligations of disclosure specified therein, the goods shall be deemed approved.
8.6 If the Client acts as a consumer, the forwarding agent has to be immediately notified of any obvious transport damages and the Seller has to be informed accordingly. Should the Client fail to comply therewith, this shall not affect his statutory or contractual claims for defects.

9) Applicable Law
9.1 The law of the Federal Republic of Germany shall apply to all legal relationships between the parties under exclusion of the laws governing the international purchase of movable goods. For consumers, this choice of law only applies to the extent that the granted protection is not withdrawn by mandatory provisions of the law of the country, in which the consumer has his habitual residence.
9.2 With regard to the statutory right of cancellation, this choice of law does not apply to consumers who do not belong to a member state of the European Union at the time of the conclusion of the contract and whose sole place of residence and delivery address are outside the European Union at the time of the conclusion of the contract.

10) Code of conduct
10.1 The Seller has agreed to the conditions of participation for the e-commerce initiative "Fairness in Commerce", which can be viewed on the Internet at https://www.fairness-im-handel.de/teilnahmebedingungen/.
10.2 The Seller is subject to the Google Customer Reviews Guidelines, which are available on the Internet at https://support.google.com/merchants/topic/7105962

11) Alternative dispute resolution
11.1 The EU Commission provides on its website the following link to the ODR platform: https://ec.europa.eu/consumers/odr.
This platform shall be a point of entry for out-of-court resolutions of disputes arising from online sales and service contracts concluded between consumers and traders.
11.2 The Seller is neither obliged nor prepared to attend a dispute settlement procedure before an alternative dispute resolution entity.

 

General Terms and Conditions of Maschke Academy and RickFlix

  1. Scope

These General Terms and Conditions (GTC) apply to all business relationships between the Maschke Academy, hereinafter referred to as "Academy", and its customers in the field of online further education, in particular for the products "Maschke Academy - Your accompanying further education in the field of image editing" and "RickFlix".

  1. Services of the Academy

The Academy offers online further education. The knowledge is mainly conveyed through videos. In addition, live calls can take place as part of the educational offering. The number of live calls can vary. The live calls are exclusive events that only Academy participants may attend.

  1. Live Calls

Live calls will not take place if there is a public holiday in a federal state of a coach. In addition, the Academy reserves the right to cancel or postpone live calls without further reason.

  1. Access

Access to the Academy and live calls is generally not limited in time once you are a participant of the Academy. Exceptions may apply to buyers of special offers, where the duration of access is determined by the rules specified in the offer.

  1. RickFlix

Participants in the Academy do not necessarily have access to RickFlix. Deviations may apply to special offers. RickFlix participants have access to an extensive library of courses and other materials. In addition, RickFlix participants automatically have access to all webinars taking place within the framework of RickFlix, unless corresponding exceptions occur.

  1. Sharing of Account Data

The sharing of account data, which allows multiple people to access the course materials via one account, is strictly prohibited. Violation of this rule leads to immediate suspension and revocation of access.
